Vigil and Rally on 1^st Anniversary of the Murder of Kerry Baxter Junior

One year ago on January 16, 2011, Kerry Baxter Junior, was executed in front of Saint Anthony Church in East Oakland. According to witnesses Kerry was sat upon by two African American males by San Antonio Park. He had accompanied two female friends and was standing by his car when approached by the gunmen. They first told him to give them all of his money before telling him to run for his life.

He was chased around the corner and shot in front of the church, where he died. One witness stated there was a Dark Blue or Black Van that sat there until the Ambulance and Police arrived. The Police Department has done little to solve the killing even though there were two eyewitnesses. When the family calls, they are ignored or told there is nothing new. They have not posted a description of the assailants or a reward for their capture.

On January 16^th at 6:00 pm, the Oscar Grant Committee, and Kerry Juniors family will gather to honor his memory and demand answers from the Oakland Police Department, the Citizens Police Review Board, and the Internal Affairs Division of the Oakland Police Department. The Community to join in remembrance of Kerry Junior and others whose lives were taken by Street Violence. We want solutions to the needless killing of our children.

“Kerry’s Murder has left a void in our family that can never be filled. We will not see him marry, have children, graduate from College, or smile ever again. Those who murdered him do not understand the pain his family is going through,” said his Grandmother Anita Wills who is a member of the Oscar Grant Committee.

A Modern Day Lynching: The Wrongful Conviction of Kerry Baxter Senior

Kerry Baxter Senior was thirty-one years old when he was sentenced to sixty-six years in Prison, in December of 2001. The conviction was for the 2nd Degree Murder of an innocent bystander in Oakland California. Most Americans believe that the Police, Courts, and District Attorney's are here to represent the people. Why then would the Oakland Police, District Attorney, and Courts allow the wrongful conviction of a taxpaying Citizen? Why would a Newspaper like the Oakland Tribune spew out negative, unchecked information about Kerry Baxter Senior? Why would the Media and Justice System paint the assailant of my son, Jahmani Jones (twenty years old), as a victim of my son? Why would the DA and Oakland Police give Jones, Blanket Immunity to testify against Kerry Baxter Senior? Why did they hide the fact that Jones was a convicted Felon, and on Parole in Merced County at the time of the incident? Why did the DA and Oakland Police Department not prosecute Jones when he was committing Armed Robbery and Assaults after his Blanket Immunity Deal? These are the Questions the questions that came to mind and that this article attempts to answer.

Following is a version of the events of March 30, 2001, as I understand them:

            Kerry Baxter Senior is my son and was a working member of the Carpenter's Union in 2000, when the events transpired. He was friendly with the owners of the Martinique a bar in East Oakland. He struck up a friendship with the bar owner, Mr. Harris when he was apartment setting for me. The bar was just a small neighborhood place that attracted an older crowd. After the altercation, my son stated that there was a gang of young men who stood in front of the bar taunting patrons. I believe the situation escalated when my son approached the gang members, and tried to reason with them. I have read the court transcripts and the description of Jones is chilling, especially the crimes he has committed. Most of his crimes were committed by assault and/or with guns. In his deposition at Kerry Baxter Seniors Trial he stated that he had NEVER fired or had a weapon. However, this is not just about Jones, but those who awarded him Blanket Immunity, Deputy District Attorney Colleen McMahon, and Homicide Detective Brian Maderia. Sadly they are the same two who are responsible for finding and prosecuting the murderer of my grandson, and that has not happened. They have turned my family and I into the bad guys for demanding that Kerry Baxter Senior, be given a Fair Trial.

        The incident involved an innocent man, Anthony Blake who was supposedly shot in the chest and died. Yet, the Medical Examiner Report States that the bullet entered his neck from a downward Projectile, and exited his right side. Witnesses describe him as bleeding from his mouth and did not mention any chest wounds. As far as i know the Corner's Report did not make it in front of the Jury. Most of the testimony at the trial was about what Kerry did when he was eighteen years old. He took a plea for shooting another young man in the arm. The back story is that the Oakland Police took him downtown and kept him for hours. They told him that the young man had killed his friend, who had earlier been shot in the head. They dropped my son off early in the morning and then went to the young man's house. The other young man did not testify against Kerry, and Kerry's friend did not testify against the other young man. Kerry took a plea and was sent to jail and put on Parole. Unlike many white males, African American young men committing crimes are labeled for life.

              He said that the young men referred to him as Original Gangster, (OG), and Jahmani (the self-appointed leader), had approached him a few times. According to Court Transcripts Jahmani stated that he believed Kerry was after him for shooting out the window of his mother's SUV. Yet I was not questioned about whether or not the Window was shot out and Kerry's reaction. Kerry told me about the window being shot out, but he did not know who did it. The window was shot out in November of 2000, and the incident did not take place until March 2001. The truth is it was not Kerry asking about the window; it was Jahmani, who was spoiling for a fight, he testified that he heard Kerry was, "Strapped" that night.

Yet, he says he approached him with no weapon only his friends (who were also supposedly unarmed). This sounds like a bad fiction Movie, except that it is all too real. Jahmani Jones states that he and his friends went in to the bar and summoned Kerry outside. They went outside and after a brief exchange, Jahmani pulled out a gun, and shot at my son, who also had a gun. According to my son, before shooting at him, Jahmani told him, “I got something for you.” Jahmani’s bullet did not connect, but the one Kerry fired hit him in the foot. This was the bullet that Officer Brian Maderias stated ricocheted and hit the victim in the chest. Later Officer Maderias attempted to coerce Kerry's girlfriend into saying Kerry told her he shoot at Jones three times. If he shoot him one time in the foot, disabling him why would he miss with two other shots. The truth is that Kerry ran after the first shot as Jahmani's gang pursued and shot at him.

That night shell casings littered the ground, according to testimony from neighbors who came on the scene. It appears that one of the investigators, Sergeant Longmire was interviewing Jahmani Jones as a suspect, but he was quickly replaced by Oakland’s own Mark Furman, Sergeant Brian Madeira’s. There is not much difference Madeira’s and Furman, as far as their records go. Madeira has had numerous complaints of Civil Rights violation, and almost all are African American. In one case, the city paid out upwards of $73,000.00, to settle an abuse claim. The fact is that taxpayers are picking up the tab for OPD Officer Misconduct.

The Knight Riders were a gang of Oakland Police Officers who assaulted and robbed young black men in the community. After a community outcry, they were indicted and after a hung jury retried. There was no indictment or conviction even with all of the evidence. The same judge oversaw the trial of my son and allowed false testimony from Officer Brian Madeiras and Jahmani Jones. All of the African Americans were stricken from the Jury and Jahmani was made a victim of Kerry. The OPD also face a law suit from the death of a man who had been beaten by OPD and later died. His name was Jerry Ayala, and he died a year before the incident with Kerry and Jahmani. In that case Maderias was accused of covering up for the Officers and stating that Ayala had been beaten by a Gang in Oakland.

After all was said and done, Officer Madeira’s was given a promotion to Lieutenant of Homicide. He is now an, “Expert” on Gangs in Oakland, and like Jahmani Jones, the complaints against him are not readily available. In Kerry's case, there were no cameras, high priced attorneys, or audience to bear witness. However, there are depositions, and records, which contradict what Madeira’s and Jones said at trial. My hope is that the citizens will take peaceful action, against this hostile force. I say that because my belief (and I hope to be proven wrong), is that they would love a riot, and a chance to shoot Civilians. They have the support of organizations like, the Tea Party, District Attorney's Office, and the Courts, even when they lie. It is not just about race, it is a mentality, in which they (the Police), are the Good Guys, and any action taken is right. There is Nepotism, even though it is against the Policy's stated by the City of Oakland. The DA and Justice System allow the Police to lie, but will prosecute a citizen for lying to the Police.

There was no justice for the victim nor for Kerry Baxter Senior. The wrongful conviction caused his boys quality of life to drop drastically. His two boys have grown up without a father and his oldest son Kerry Baxter Junior was Shot and Killed on January 16, 2011. While he was in prison, his youngest sister got married, his father died, and his grandmother passed away. The reason for this travesty of Justice is that (IMHO), Jahmani Jones was an informant. He was asked that question at Kerry's trial and did not give a definitive answer. The DA jumped up and objected and the judge sustained the objection. Yet, he was the one who brought it up by saying that Kerry had called him a, "Snitch." After my son was convicted, Brian Maderias was in a film about Oakland Street Gangs. He is supposedly an expert on Oakland Street Gangs, but blocked any mention of Jahmani Jones being in a Gang. At court Kerry was accused of being a Gang member, at the age of thirty-one. Yet Jahmani Jones who was twenty and with his gang members that night, is never mentioned as a gang member. None of the group that surrounded my son that night were called to testify by the DA. Although Kerry was accused of being a drug dealer and Gang Member, the name of his gang was not mentioned.

It is important for the community to become educated about what is going on. We have taxpaying citizens being set up by the Police, while an informant with numerous Felony Convictions is allowed to run free. Jahmani Jones has continued to commit felony's and has yet to receive one strike. He was in jail for Murderous assault on his wife but is now a free man. Could he be a Lovelle Mixon (who killed four Oakland Police Officers in 2009) in the making? If so then the System is responsible for creating people who terrorize Urban Areas like Oakland California.

They are intent on enslaving, assimilating, or murdering African American Males. No different from what went on with the Natives, who are almost extinct as an Ethnic Group.

Governor Pete Wilson signed a "Three Strikes, You're Out" bill into law on March 7, 1994, which doubled sentences for those convicted of a second felony offense, and imposed life sentences for those convicted a third time. This law is primarily used to imprison blacks and Hispanics.

Corner's Report of injury			Coroner description is of bullet entering Neck Above Left Clavicle, and lodging on the Left side of his Heart. That would seem to be a downward projectile, and not a bullet hitting him straight in the heart (as OPD stated). It is more consistent with a witness who stated that Blake was sitting in a car when he was shot, and not the Police account of him standing in front of the Martinique Bar.
